Horsham District Council
Section 106 Funding for Community Projects
Horsham District Council passes on Section 106 money paid by developers as capital funding for community infrastructure, such as village hall improvements, new play equipment and sports changing facilities. Funds differ from area to area, and a project must be directly related to the development that generated the money and help mitigate its impact. There is no deadline: groups contact the council to check suitability and available funds, and are sent an application form if they qualify.

Who can apply
- Local parish or neighbourhood councils, or local voluntary, community or not-for-profit organisations that are properly constituted with their own bank account, based in Horsham district or providing activities that benefit district residents
- Organisations must have safeguarding (children and vulnerable adults), equal opportunities, insurance and health and safety policies where appropriate
- Annual subscriptions, joining fees and session charges should be affordable to all
- Applications for building works must come from the owners of the land or building, or include formal permission, and applicants must establish whether planning permission is needed before applying
- Funding depends on Section 106 money being available in your area; the Community Infrastructure Levy has largely replaced Section 106 since October 2017, so parish councils' CIL share may be an alternative
What it funds
- Capital funds towards general community and leisure facilities, for the provision, extension, adaptation or enhancement of the facilities (recent examples: village hall enhancements, new play park equipment and new sports changing facilities)
the project must comply with the Community Infrastructure Levy regulations: it must be directly related to the development, required to mitigate the impact of the development, and reasonable in scale and in kind, along with any other legal criteria in each S106 obligation.
What it will not fund
- Revenue (non-capital) costs
- Projects that have already been completed (no retrospective funding)
- Projects which commenced before the development that generated the money commenced
- Projects that promote specific political or religious views
- Projects that unfairly exclude individuals from participation
- Increases to an award if project costs increase
How to apply
- Contact the Community Development Officer (01403 215358, community.development@horsham.gov.uk) or the Developer Contributions Technician / Planning Obligations Officer to discuss your project informally
- An initial assessment checks the project against the criteria, whether S106 funding is available and whether other funding has been sought
- If you meet the criteria and funding is available, you are sent an application form to complete
- The application goes through a consultation of at least two weeks with council departments, local parish and neighbourhood councils and district councillors, then is decided under delegated authority
- A decision letter is sent once the consultation has closed
- Payment is made once the work (or a stage) is completed, on your invoice plus a copy of the contractor's invoice; aim to complete and draw down within one year and send a brief update at the end
Have ready
- 3 quotes for the work (or a justification if this is not possible)
- Landowner's formal permission for building works, if you are not the owner
applicants should show a contribution from their own funds or fundraising and a commitment to ongoing maintenance costs wherever possible
